Small home rules in Alberta
Alberta has no provincial law requiring municipalities to allow backyard suites or a minimum number of units per lot. Each municipality decides through its own land use bylaw. Construction is governed province-wide by the National Building Code – 2023 Alberta Edition, in force since May 1, 2024.
Provincial rules
- Backyard suites by right
- No provincial by-right permissionThere is no provincial mandate. A provincial secondary suites publication tells homeowners to check municipal zoning and development bylaws to see where suites are allowed. Municipalities vary: Edmonton lists backyard housing as a use in its residential zones under Zoning Bylaw 20001, while Calgary lists backyard suites as discretionary in most districts. Law: None province-wide; zoning rests with municipalities under the Municipal Government Act [1]
- Units per lot
- No provincial minimum; set by municipal land use bylaws [1]
- Tiny homes on wheels as a full-time home
- Left to each municipalityNo provincial guidance on tiny homes or RVs as dwellings was found. For example, the City of Calgary says homes built on a chassis to RV standards are 'not certified for year-round accommodation' and are regulated as RVs. A tiny home on a permanent chassis is treated as a manufactured home, needs CSA mobile home certification, and is allowed only in the R-MH or S-FUD districts. To be lived in permanently, a tiny home must be 'built on a permanent foundation and be fully serviced with utilities.' [2]
- Building code pathway
- The National Building Code – 2023 Alberta Edition took effect May 1, 2024. Applications made before that date were reviewed under the 2019 edition. Small houses come under Part 9. A provincial secondary suites document sets a minimum ceiling height of 1.95 m for living spaces in a secondary suite. No provincial page found addresses CSA A277 acceptance or a minimum dwelling size. [3][1]

Notes and caveats
When fetched, the alberta.ca 'Codes in force' page still described the 2023 edition as 'coming into force May 1, 2024', which suggests it has not been updated since. The May 1, 2024 date is confirmed by municipal notices and the Alberta Association of Architects. I found no STANDATA bulletin or other provincial document on tiny homes, CSA Z240 RV versus MH, or CSA A277. I found no provincial incentive program.
