Backyard suite rules in Calgary
The rules at a glance
- Allowed?
- Allowed only through a discretionary approvalCouncil repealed citywide rezoning on April 8, 2026, effective August 4, 2026. About 99% of properties returned to their pre-2024 zoning. Backyard suites stay a permitted use in R-G and a discretionary use in all other districts. They are no longer allowed on properties with semi-detached homes, and a property can no longer have both a secondary suite and a backyard suite. Secondary suites became a permitted use in all low-density districts (Bylaw 26P2026).
- What it’s called
- backyard suite
- Maximum size
- 75 m² floor area, excluding stairways and landings up to 2.5 m²
- Maximum height
- 7.5 m, stepping down near neighbouring properties
- Approvals needed
- A development permit is required in most districts, followed by a building permit. In R-MH a land use redesignation is required. Minimum lot width is 9 m, or 7.5 m on a corner or lane lot with 3 or more stalls. Setbacks are 1.5 m from the rear and 1.2 m from the side, with 5.0 m separation from the main house.
- Typical timeline
- About 60 days to development permit approval (city page)
- Fees and charges
- Not confirmed from an official source.
- Parking
- One tenant stall in addition to the property's required stalls; street and tandem stalls do not count. The repeal page says 'Backyard suites will have a parking requirement again.'
- Tiny homes on wheels
- Homes built on a chassis to RV standards are 'not certified for year-round accommodation' and are regulated as RVs. A tiny home on a permanent chassis is a manufactured home, needs CSA mobile home certification, and is allowed only in R-MH or S-FUD. A tiny home on a permanent foundation with full services, added to a lot with a single detached house, is treated as a backyard suite.
